Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the East13 SEO platform ("Service"), operated by Saroj International Inc, a corporation registered in the Commonwealth of Virginia ("East13," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Service Description

East13 is a software-as-a-service (SaaS) platform that provides automated SEO services including, but not limited to:

  • SEO content generation and optimization for WordPress, Shopify, Wix, and Webflow sites
  • SERP tracking and keyword monitoring
  • Site health auditing and technical SEO analysis
  • Automated page creation and deployment
  • Content performance analytics

3. Account Registration and Responsibilities

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring that your use of the Service complies with all applicable laws
  • Providing valid website access credentials necessary for the Service to operate
  • Maintaining backups of your website content independent of the Service

You must be at least 18 years old and have the legal authority to bind the entity on whose behalf you are using the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Generate or distribute content that is unlawful, defamatory, fraudulent, or harmful
  • Violate any third party's intellectual property or privacy rights
  • Engage in any activity that constitutes spam or manipulative SEO practices prohibited by search engine guidelines
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell or redistribute the Service without our express written permission
  • Use the Service to manage websites promoting illegal goods or services

We reserve the right to suspend or terminate accounts that violate these terms at our sole discretion.

5. Intellectual Property

Your Content: You retain all ownership rights to the content generated through the Service for your websites. Content created by the platform on your behalf is owned by you once delivered to your site.

Our Platform: East13 retains all rights, title, and interest in the Service, including all software, algorithms, interfaces, documentation, and underlying technology. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements.

Feedback: If you provide suggestions or feedback about the Service, we may use that feedback without obligation to you.

6. Payment Terms

  • Pricing: Subscription plans range from $499 to $2,499 per month, depending on the plan selected.
  • Free Trial: New accounts receive a 14-day free trial. No payment is charged during the trial period. You may cancel at any time during the trial without being charged.
  • Payment Processing: All payments are processed securely through Square. By subscribing, you authorize recurring charges to your payment method on file.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled before the renewal date.
  • Price Changes: We may adjust pricing with at least 30 days' written notice before the change takes effect on your next billing cycle.
  • Taxes: Stated prices do not include applicable taxes. You are responsible for any taxes associated with your subscription.

7. Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting us at [email protected]. Upon cancellation:

  • You will retain access to the Service through the end of your current paid billing period
  • No further charges will be made after the current billing period
  • Content already generated and deployed to your sites will remain on your sites
  • Your account data will be retained for 30 days after cancellation, after which it may be deleted

8. No Guaranteed SEO Results

The Service does not guarantee specific search engine rankings, traffic increases, or revenue outcomes. SEO performance depends on numerous factors outside our control, including search engine algorithm changes, competitive landscape, website technical health, and domain authority. While the Service is designed to improve SEO performance, results vary and no specific outcomes are promised or implied.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and the Service may experience occasional downtime. We are not liable for any loss or damage resulting from Service interruptions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAST13 AND SAROJ INTERNATIONAL INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

East13 is not responsible for any negative impacts to your website's search engine rankings, traffic, or performance that may result from using the Service or from discontinuing use of the Service.

11. Indemnification

You agree to indemnify and hold harmless East13, Saroj International Inc, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Termination

We may suspend or terminate your account and access to the Service at any time if:

  • You breach any provision of these Terms
  • Your payment method fails and is not resolved within 7 days
  • We reasonably believe your use of the Service poses a security risk or may harm other users
  • We are required to do so by law

Upon termination for cause, you will not receive a refund for any prepaid amounts. We will make reasonable efforts to provide notice before termination except where immediate action is necessary.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Virginia. You consent to the personal jurisdiction of such courts.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and East13.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
